{"id":4241,"date":"2020-03-25T22:41:08","date_gmt":"2020-03-25T21:41:08","guid":{"rendered":"https:\/\/www.lh-lf.com\/?p=4241"},"modified":"2022-09-14T14:47:04","modified_gmt":"2022-09-14T12:47:04","slug":"are-flows-of-goods-included-in-the-containment-related-measures","status":"publish","type":"post","link":"https:\/\/www.lh-lf.com\/en\/are-flows-of-goods-included-in-the-containment-related-measures\/","title":{"rendered":"Are flows of goods included in the containment-related  measures?"},"content":{"rendered":"<h1>Update on Customs measures related to COVID-19<\/h1>\n<p style=\"text-align: center;\"><em>By Stanislas ROQUEBERT<\/em><\/p>\n<p>&nbsp;<\/p>\n<p>While people see their freedom of movement drastically, but necessarily, restricted, the same cannot<br \/>\nbe said for goods that must continue to move: show must go on!<\/p>\n<h2>I- What about the free movement of goods within the EU?<\/h2>\n<p>The free movement of goods is not questioned. Both the European Commission and the Member States<br \/>\nhave communicated clearly to this effect.<\/p>\n<p>However, in practice, emergency measures adopted by some Member States may necessarily affect the<br \/>\ntransport of goods between Member States since some borders (e.g. between Spain and France) may<br \/>\nbe closed or restricted.<\/p>\n<h2>II- And with non-EU countries, can we still import\/export?<\/h2>\n<p>At this stage, no import\/export restrictions have been promulgated for certain products or countries.<br \/>\nMovement restriction measures do not apply to goods.<\/p>\n<p>On the contrary, the movement of goods is well maintained, especially with the United States (i.e. the<br \/>\nrestrictions imposed only concern people), and China, since scientists consider that \u00ab\u00a0the risk of being<br \/>\ninfected with the Covid-19 Coronavirus by touching an object imported from a risk area is considered<br \/>\nto be extremely low\u00a0\u00bb.<\/p>\n<p>In practice, some trade could of course be restricted (e.g. the port of Le Havre has decided to limit the<br \/>\narrival of ships, and the majority of cargo travels on passenger flights, which are also severely restricted),<br \/>\nbut there are no restrictions in principle and the time of stupor will necessarily give way to effective<br \/>\npractical supply chain organization.<\/p>\n<p>Finally, and given the current circumstances, personal protective goods such as masks and gloves, but<br \/>\nalso food products, should be subject to import flexibilities rapidly.<\/p>\n<h2>III- Is it still possible\/necessary to carry out import and export customs clearance formalities?<\/h2>\n<p>Obviously, customs clearance formalities must be carried out independently of the current situation<br \/>\nsince any import\/export must be subject to the filing of a declaration at all times.<\/p>\n<p>In this sense, the administration continues to function remarkably:<br \/>\n\u2022 All customs declarations are computerized and the software work;<br \/>\n\u2022 The customs officials are currently in a teleworking system. A minimum service is therefore<br \/>\nefficiently guaranteed.<\/p>\n<h2>IV- Is the payment of customs duties suspended or facilitated?<\/h2>\n<p>At this stage, the emergency measures taken by the French Government only concern direct taxes, but<br \/>\nnot customs duties or indirect contributions (excise duties, ICT, etc.).<\/p>\n<p>Nevertheless, the Customs authorities has confirmed \u00ab\u00a0that in case of emergency and in accordance with<br \/>\nthe regulations in force, situations will be studied on a case-by-case basis\u00a0\u00bb.<\/p>\n<h2>V- What about ongoing customs controls?<\/h2>\n<p>The ongoing controls are continuing, and new controls can be initiated, even if the administration is<br \/>\nnecessarily busy on other priorities.<\/p>\n<p>Some practical situations:<\/p>\n<ol>\n<li>I have 15 days to provide documents or answer questions, do I have to do so?<\/li>\n<li>I have received a notice of the outcome of an investigation and have 30 days to make comments, is the deadline suspended?<\/li>\n<li>I have received a notice of payment following a notification of infringement, requesting payment within 10 days, is the time limit suspended?<\/li>\n<li>I have received an assessment notice; do I have to make payment or dispute promptly?<\/li>\n<\/ol>\n<p>Please note that deadlines are always running and there is no general suspension. Nevertheless, the<br \/>\nCustoms authorities have confirmed that they will probably not oppose extensions of time limits given<br \/>\nthe context.<\/p>\n<p>This is why we recommend, as a precaution, to request in writing and in a reasoned manner additional<br \/>\ntime limits (in particular for observations to notices of investigation results or assessment notice<br \/>\ncontestation), justified by the containment. For companies, their boards and the Customs Authorities,<br \/>\nit seems preferable, except in emergencies, that the pre-litigation\/litigation activity regains its full effect<br \/>\nafter containment.<\/p>\n<p>This being said, it is important to continue the procedures in progress in order to avoid a harmful<br \/>\nbottleneck when the situation has returned to normal and we recommend, if at all possible, to<br \/>\nrespond\/advance as far as possible.<\/p>\n<h2>VI- What about ongoing Customs disputes in Courts?<\/h2>\n<p>As far as judicial and customs procedures are concerned (except for specific criminal proceedings), it<br \/>\nhas been agreed with the courts, the National Bar Association and professional associations, to request<br \/>\nthe postponement of all the proceedings scheduled for the next few weeks until the situation returns<br \/>\nto normal.<\/p>\n<p>For all scheduled hearings, we therefore recommend, as a precautionary measure, to request referrals<br \/>\nand to follow the procedural deadlines, including during periods of confinement. Likewise, we recommend taking advantage of these calmer times to make progress on possible conclusions or draft<br \/>\nwritings in order to be reactive and avoid bottlenecks during the resumption.<\/p>\n<h6><i><span lang=\"EN-US\">This publication has been prepared for general guidance on matters of general interest only and does not constitute professional advice.
